1. Agreement to Terms

These Terms of Use constitute a legally binding agreement between you and Beautycallbeauti, a personalized outdoor activity planning service operating at beautycallbeauti.world and located at 62 South Terrace, Darfield 7510, New Zealand. By accessing our website, submitting inquiries, or purchasing any of our trail plan packages, you agree to be bound by these terms in their entirety. If you disagree with any provision, you must discontinue use of our website and services immediately.

2. Description of Services

Beautycallbeauti provides personalized outdoor activity planning services delivered as digital documents. Our core products include the Coastal Explorer Day Plan priced at $95 NZD, the Alpine Ridge Weekend Plan priced at $165 NZD, and the Family Forest Discovery Plan priced at $125 NZD. Each package includes customized route recommendations, timing schedules, gear lists, safety notes, and local guidance based on information you provide during consultation. Our services are planning and advisory in nature; we do not provide guided tours, physical escort services, equipment rental, or transportation.

3. Eligibility

You must be at least eighteen years of age or have the legal capacity to enter into binding contracts under New Zealand law to purchase our outdoor activity plans. By using our services, you represent that you meet these requirements. If you are purchasing a plan on behalf of a group that includes minors, you accept responsibility for ensuring all participants are adequately prepared for the recommended activities.

4. Orders and Payment

All orders for trail plans are subject to acceptance by Beautycallbeauti. We reserve the right to decline orders where requested routes are inaccessible due to seasonal closures, safety concerns, or insufficient information from the client. Prices displayed on beautycallbeauti.world are in New Zealand dollars and include GST where applicable. Payment must be received before plan development commences unless otherwise agreed in writing. Rush delivery within twenty-four hours is available for an additional $35 NZD upon request and subject to planner availability.

5. Plan Delivery and Revisions

Standard delivery of personalized outdoor activity plans occurs within two business days of receiving your complete preference information and confirmed payment. Delivered plans are provided electronically via email in PDF format unless otherwise requested. Each purchased plan includes one complimentary revision within fourteen days of delivery. Additional revisions are available at $25 NZD each. Revision requests must clearly specify the changes desired and remain within the scope of the originally purchased package type.

6. Intellectual Property

All content on beautycallbeauti.world, including text, graphics, logos, plan templates, route descriptions, and website design, is the intellectual property of Beautycallbeauti or its licensors and is protected by copyright and other intellectual property laws. Upon full payment, you receive a personal, non-transferable license to use your delivered plan for your own outdoor activities. You may not reproduce, distribute, sublicense, sell, or publicly share any plan document or substantial portions of our website content without prior written consent from Beautycallbeauti.

7. User Responsibilities

You agree to provide accurate and complete information when requesting outdoor activity plans, including honest assessments of fitness levels, experience, and group capabilities. You acknowledge that outdoor activities in New Zealand involve inherent risks including uneven terrain, changing weather, wildlife encounters, and physical exertion. You are solely responsible for assessing your ability to undertake recommended routes, carrying appropriate safety equipment, checking current conditions before departure, and complying with all Department of Conservation regulations and local bylaws. Beautycallbeauti plans are recommendations based on information available at the time of creation and do not guarantee specific outcomes or conditions on the day of your activity.

8. Limitation of Liability

To the maximum extent permitted by New Zealand law, Beautycallbeauti, its directors, employees, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of our outdoor activity plans or participation in recommended activities. This includes but is not limited to personal injury, property damage, financial loss, or dissatisfaction resulting from weather changes, track closures, navigation errors, or differences between planned and actual conditions. Our total liability for any claim related to our services shall not exceed the amount you paid for the specific plan giving rise to the claim. Nothing in these terms excludes liability that cannot be excluded under the Consumer Guarantees Act 1993 or other mandatory New Zealand consumer protection legislation.

9. Disclaimer of Warranties

Our outdoor activity plans are provided on an as-is basis. While Beautycallbeauti exercises reasonable care in researching routes and conditions, we make no warranties, express or implied, regarding the accuracy, completeness, or suitability of any plan for your specific circumstances. Track conditions, weather, access permissions, and infrastructure may change without notice after plan delivery. You are advised to verify critical details independently before undertaking any outdoor activity.

10. Acceptable Website Use

When using beautycallbeauti.world, you agree not to: attempt unauthorized access to our systems or data; transmit malicious code or harmful content; scrape or harvest website data for commercial purposes without permission; impersonate Beautycallbeauti or its representatives; submit false or misleading information through our contact forms; or use our services for any unlawful purpose. We reserve the right to suspend or terminate access for users who violate these provisions.

11. Third-Party Links and Resources

Our website and delivered plans may reference third-party resources such as Department of Conservation websites, weather services, and mapping tools. Beautycallbeauti does not control and is not responsible for the content, accuracy, or availability of third-party resources. Inclusion of any external reference does not constitute endorsement. 12. Indemnification

13. Governing Law and Disputes

These Terms of Use are governed by the laws of New Zealand. Any disputes arising from or relating to these terms or our outdoor activity planning services shall first be attempted to be resolved through good-faith negotiation between the parties. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of New Zealand. Nothing in this section limits your rights under the Consumer Guarantees Act 1993 to seek remedies through applicable dispute resolution mechanisms.

14. Modifications to Terms

Beautycallbeauti reserves the right to modify these Terms of Use at any time. Updated terms will be posted on beautycallbeauti.world with a revised effective date. Changes apply to new orders placed after the effective date. Existing orders remain subject to the terms in effect at the time of purchase unless otherwise required by law.

15. Severability

If any provision of these Terms of Use is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties.
